Wattie’s Birthday Wish, Win up to $250,000 Terms and Conditions

1. Entry into this competition is deemed acceptance of these and any other applicable Terms and Conditions. This competition may have additional Terms and Conditions and wherever possible the additional Terms and Conditions will be posted at www.newworld.co.nz. 

Promoter

2. The Promoter of this competition is Foodstuffs (NZ) Limited (‘Foodstuffs’) and Heinz Wattie’s Limited (NZCN 540128), of 2 Nuffield Street, Newmarket, Auckland 1023, New Zealand (‘Supplier’) jointly (Promoter).

Promotion Period and how to enter

3. The competition commences at 12.01am NZST on 08/04/24 and closes at 11.59pm NZDT 05/05/24 (Promotion Period).

Eligible Purchase 

4. You will receive one entry in the draw when purchase in a single transaction three (3) or more Wattie’s, products during the Promotion Period and scan your Clubcard instore (Loyalty Card) at the time of payment, or when you enter your Clubcard details before the time of payment for online  purchases (Eligible Purchase) at all New World stores nationwide including purchases made from New World’s online shopping channel and through the mobile application. 

5. You will only receive one entry into the competition even if you purchase multiple participating products in your Eligible Purchase.

Eligibility to enter and to win a prize

6. To be eligible to enter this competition and win a prize:

a) you cannot be a New World or Clubcard staff member; 

b) you must have made an Eligible Purchase and scanned your Clubcard at the time of purchase;

c) you must be a current Clubcard member; 

d) you must consent to Foodstuffs using your name, photo, hometown and image for publicity and promotional purposes (including the display of your name in store) and you must make yourself available for publicity photographs relating to the competition on request for no additional compensation. 
e) If you are under 18 years old at the time of entering, you must obtain the prior permission and consent of your legal parent or guardian. Your parent or guardian must read these Terms and Conditions and may be required by the Promoter to enter into a further agreement as evidence of consent. Any Prize will be awarded to the successful entrant’s nominated parent or guardian.

How winners will be selected

7. A single winner will be drawn by Loyalty New Zealand Limited (Loyalty) on behalf of Foodstuffs by 20/05/24, or after the end of the Promotion Period, by random electronic selection from all eligible entries. There will be one (1) winner drawn. The Prize Winner must be available to attend the Winner’s Event (or nominate a Proxy to attend on their behalf) to be held within six weeks of them being drawn the winner, at the New World  supermarket closest to their residential address. 

8. The Game is played at the Event where Outcomes 1,2 or 3 (outlined below) will occur.

9. The Prize includes the opportunity to play a Game (details of the Game below) at the Winner Event for the chance to win:

$250,000 NZD cash, (Major Prize) (this prize will only be awarded if the Prize Winner achieves Outcome 1 of the Game); 
A prize of $5,000 cash (Minor Prize) (this prize will only be awarded if the Prize Winner achieves Outcome 2 of the Game); or
A prize of $2,500 NZD cash (this prize will only be awarded if the Prize Winner achieves Outcome 3 of the Game).
10. The Game
The Game will take place no later than 07/07/2024 at a time between 9.00am and 5.00pm NZST at the New World supermarket closest to the winners residential address. The date and venue of the Game will be advertised when the Prize Winner is verified. The Prize Winner has the chance to win the Major Prize.
The Game will consist of twenty unique (20) tamper-proof envelopes, whereby: 
a) two (2) tamper-proof envelopes will contain promotional messages representing winning symbols; and
b) the other eighteen (18) tamper-proof envelopes will each contain promotional messages representing non-winning symbols (Game).

11. To play the Game, the Prize Winner must choose two (2) tamper-proof envelopes without touching, handling or interfering in any way with any of the other tamper-proof envelopes on display. If the Prize Winner is found to have breached this condition, he/she will be disqualified. 

a) Outcome 1: If the Prize Winner selects the two tamper-proof envelopes containing promotional messages representing the winning symbols, then, subject to verification by the judges, the Prize Winner will win the Major Prize of $250,000.
b) Outcome 2: If the Prize Winner selects one (1) tamper-proof envelope containing a promotional message representing one winning symbol and selects one (1) tamper-proof envelope containing a promotional message representing one non-winning symbol, then the $250,000 prize will not be given away and, subject to verification by the judges, the Prize Winner will win the Minor Prize of $5000.
c) Outcome 3: If the Prize Winner selects two (2) tamper-proof envelopes containing a promotional message representing two (2) non-winning symbols, then the $250,000 prize will not be given away and, subject to verification by the judges, the Prize Winner will receive the Consolation Prize of $2,500.

If prize becomes unavailable

12. Subject to any applicable law that cannot be excluded, Foodstuffs is not responsible or liable for any loss suffered by any entrant in the event that a prize becomes unavailable for reasons beyond its control. In this event, Foodstuffs may substitute a prize of its choice.

Notifying winners

13. Winners will be notified by Foodstuffs or the Supplier once a draw has been completed within 
5 working days of the draw, via the contact details on record for the Loyalty Card used to enter the competition (or the primary Clubcard card holder if a secondary card was used). In the event that a winner cannot be contacted within 5 working days of a draw occurring or if Foodstuffs determines that a winner is not eligible to participate in a draw the prize will be forfeited, a further draw will be conducted, and the prize allocated to the new winner.

14. Foodstuffs is not responsible if a winner cannot be contacted following the draw due to incorrect or out of date contact details being recorded in the Loyalty Card’s system, and any such winner will forfeit the prize to the next eligible winner, on these Terms and Conditions.

Prize conditions

15. If the winner does not respond to the invitation to the event or does not attend the event (or the winner nominates a representative and the representative does not attend), the Game is not played and the consolation prize is awarded.

16. The Prize will be deposited to the winner’s back account within 30 business days. The winner must provide his or her bank account details to the Promoter to receive the Prize. 

16.17. Prizes are not transferable, exchangeable or negotiable. 

17.18. The selection results are final and no correspondence will be entered into.

18.19. Winners can only be awarded one prize. If a winner is drawn for any additional prize, the prize will be forfeited, a further draw will be conducted, and the prize allocated to the new winner.
Verifying compliance with these terms
19.20. Foodstuffs reserves the right to verify the identity of any entrant (including an entrant's identity, age, city/town of residence and place of employment) and to verify the validity of entries and to disqualify any entry or refuse to award a prize where false or misleading details have been given by an entrant, or an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these Terms and Conditions. 

Exclusion of liability

20.21. Subject to any applicable laws which cannot be excluded, Foodstuffs, any Participating Store, their respective employees and agents will not be liable for any loss, damage or injury of any nature incurred or suffered by any person (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with this competition or with winning, redeeming or benefiting from the prize.
Disputes
21.22. In the event of a dispute concerning any aspect of the competition including eligibility the decision of Foodstuffs will be final. No correspondence concerning any decision made by Foodstuffs will be entered into.

Additional terms

22.23. In addition to these Terms and Conditions, Terms and Conditions of your Loyalty Card, depending on the card you scan or enter for an Eligible Purchase will also apply and can be viewed at www.clubcard.co.nz.

23.24. The Promoter reserves the right to amend, suspend or terminate the competition and these Terms and Conditions at any time. 

Privacy

24.25. Your personal information may be used to conduct this competition and for future promotional and publicity purposes in relation to this competition.  By entering this competition, you consent to the use of your personal information for these purposes and we may use your personal information in accordance with these Terms and Conditions. Foodstuffs’ New World Privacy Policy will apply to all personal information that Foodstuffs  collects from you.  The Supplier’s Privacy Policy [see appendix] will apply to all personal information that is collected by, or shared with, the Supplier.

Information About Us

This Privacy Policy is intended to cover Heinz Wattie’s Limited (Wattie’s) and where applicable includes its directors, employees, related companies and the following Kraft Heinz affiliates: Cerebos Gregg's Limited (New Zealand), H.J. Heinz Company Australia Limited (Australia), Golden Circle Limited (Australia), Cerebos (Australia) Limited and Kraft Heinz Foods Company (United States Operating Entity). When we say “Wattie’s” or “Kraft Heinz”, “we”, “us” or “our” we are referring to Wattie’s or the Kraft Heinz affiliate responsible for processing your Personal Information.
We are regulated (as relevant) by the Privacy Act 2020 (Privacy Act) containing the Information Privacy Principles and the Unsolicited Electronic Messages Act 2007.

Collection of Your Personal Information

“Personal Information” means any information about an identifiable individual. It does not include information which you cannot link to a specific person, such as Aggregated Information, as described below.  Your Personal Information is therefore information about and linked to you.
We may collect, use, store and transfer different kinds of Personal Information, which could include:
Identity and Contact Information such as first name, last name, marital status, date of birth, gender, home address, billing address, email address and telephone numbers;
Financial Information such as bank account and payment card details;
Transaction Information which may include details of purchases you have made from us;
Technical Information such as an internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website;
Profile and Usage Information such as your website username and password, purchases or orders made by you, information about your interests, preferences, feedback and survey responses and how you use our website, products and services;
Marketing and Communications Information such as your preferences in relation to receiving marketing from us and third parties and for the ways we communicate with you;
Social Media Information such as likes, comments and other interactions with our social media accounts.
We also collect, use and transfer Aggregated Information such as statistical or demographic information. Aggregated Information may be derived from your Personal Information but is not Personal Information because it does not directly or indirectly reveal your identity.  For example, we may aggregate your Usage Information to find out how many users access a specific website feature.
If we combine or connect Aggregated Information with your Personal Information so that it can directly or indirectly identify you, we treat the combined data as Personal Information and will process it as set out in this Policy. 
We may collect some items of Sensitive Personal Information (which could include information about your race or ethnicity, religious or philosophical beliefs, sexual orientation, political opinions, information about your health or biometric data) but will only do so where this is provided to us by you (or is provided to us with your consent) or we believe it is necessary to fulfil our legal obligations or in connection with issues relating to our products or for some other reason that we will advise you of when we request your consent to collect the information.

How Your Personal Information is Collected

We use various methods to collect your personal information, including:
Directly from you – where you give us Personal Information such as your Identity, Contact, and Marketing Information by filling in forms or by communicating with us by email, post, phone or otherwise.  This includes Personal Information you provide when you:
o apply to receive our products or services;
o create an account on our website;
o subscribe to our services or publications;
o request marketing material to be sent to you;
o enter a competition, promotion or survey;
o contact us on social media (such as Instagram, Facebook or Twitter); or
o directly interact with our social media accounts or advertising, such as by posting or liking posts and/or on our website such as by reviewing products, liking or downloading recipes; or
o provide feedback or raise a concern or complaint.
When you contact us by phone, email or social media we may keep a record of that communication.

From third parties and publicly available sources.  In some instances, we may collect your Personal Information from various third parties that may include:

How We Use or Disclose Your Personal Information

We collect, use and disclose your Personal Information for a range of purposes where lawfully permitted.  Most commonly, we will use your Personal Information for the following purposes:
where necessary to establish and perform your agreement with us, such as where you buy products directly from us;
where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests;
where we need to comply with a legal or regulatory obligation.
Generally, we do not rely on consent as a legal basis for processing your Personal Information although we will obtain your consent before:
sending third party direct marketing communications to you via email or text message;
obtaining Contact Information from our third party partners;
sending targeted advertising to you on social media platforms such as Instagram and Facebook.

We may use your Personal Information for or in connection with the following purposes:
1. Where necessary to establish and perform your agreement with us, such as where you buy products directly from us;
2. Where necessary to comply with a legal obligation;

compliance with applicable procedures, laws or regulations including in relation to retaining records or business activities or payment of taxes;

the proper conduct and development of our business and operations;
to notify you of products and services that may assist you, by direct marketing including any special offers available;
to personalize your experience when logged into the Wattie’s website;

operation, maintenance and development of our systems, networks and the equipment associated with or connecting to those systems and networks;

dealing with actual and potential shareholders, investors and other stakeholders in our business;

We may, where necessary for our business, contract various services associated with our functions and activities to third parties.  This may involve the disclosure and sharing of your Personal Information to other persons or organisations that we engage on our behalf or to other companies within the Kraft Heinz affiliates described in the Information About Us section above subject to this Privacy Policy and the provisions of the Privacy Act.

Advertising and Promotional Offers from Us

We may use your Identity and Contact, Technical, Usage and Profile Data, including Identity, Contact and Profile Information we have received from data brokers and/or aggregators such as LiveRamp which have operations in a number of countries including the United States and United Kingdom to form a view on what we think you may want or need, or what kinds of products and services may be of interest to you.  Combining information from multiple sources in this way is commonly known as “enriching data” or “profile building”. This is how we decide which products, services and offers to include in marketing messages we send. This process may involve automated decision-making to determine which marketing messages will be most meaningful to you.  If you would not like us to use information from data brokers and/or aggregators to enrich the information, we have collected from you or if you would like to object to automated decision-making, please contact the Data Privacy Team at [email protected].
We will not use Sensitive Personal Information in building a profile about you unless you give us your consent to do so.
You can ask us to stop sending you email marketing messages at any time by clicking on the “unsubscribe” link within the message or by contacting the Data Privacy Team at [email protected].
We may also use your Identity, Technical, Usage, and Profile Data to help us understand the types of products and services that might be of interest to other consumers like you.  To do this, we partner with digital media companies such as Meta, or digital media buying platforms such as The Trade Desk, to identify and deliver marketing messages to audiences of their consumers who share your characteristics, which are known as “lookalike audiences.”  We will not use any Sensitive Personal Information we collect from you to create lookalike audiences unless you give us your consent to do so.  Delivering advertising to you through lookalike audiences involves the use of automated decision-making to build the lookalike audiences and deliver marketing messages to them.  If you would like to object to our use of automated decision-making, please contact the Data Privacy Team at [email protected].

Unsolicited Personal Information

Unless otherwise specified in this Privacy Policy, we generally only collect Personal Information directly from you. If we do receive your Personal Information without requesting it (unsolicited), we will treat such information in the same way as if we had asked for it, that is, in accordance with this Privacy Policy and the Privacy Act.
If within a reasonable time, we determine that the unsolicited Personal Information received by us is not reasonably necessary for one or more of our functions or activities or where it is it collected by unlawful and unfair means or without your consent, we will destroy or de-identify your Personal Information as soon as is practicable, but only if it is lawful and reasonable to do so and if the information is not contained in a government record.

Security of Your Personal Information

We take reasonable steps to protect your Personal Information from misuse, interference and loss and from unauthorised access, modification or disclosure.  We do this by means of various physical and electronic security measures, including restricting physical access to our offices and implementing several technological and security policies and procedures. 
We may use servers outside New Zealand to process and store your Personal Information. A number of policies and procedures are in place to ensure the safety and secure storage of your Personal Information handled and stored by Us subject to this Privacy Policy and the provisions of the Privacy Act.

Data Retention

We are required by law to retain various types of records for different periods, depending on their contents.
We will therefore keep Personal Information for as long as we reasonably consider we may need to in connection with those obligations.
Where we no longer require your Personal Information for the purpose for which this information was collected, we will take all steps reasonable in the circumstances to destroy the information.

Use of Your Personal Information for Direct Marketing

We only use or disclose your Personal Information for direct marketing purposes (that is, to communicate with you directly to promote our goods and services which may include communications with you on other social media platforms such as Instagram and Facebook) when we have your permission to do so, or where you have a reasonable expectation that your Personal Information will be used for this purpose and where you have not opted out from Us contacting you.

Access to Your Personal Information

You may request details of the Personal Information we hold about you be deleted or for it to be corrected, edited or have its processing restricted by writing to us. We will respond to your request within a reasonable period of time and give you access to the information in the manner requested by you if it is reasonable and practicable to do so.
If in the unlikely event that we deny you access to any Personal Information following an access request or provide you with access not in the manner requested by you, we will give you a written notice that will set out the reasons for the denial and the mechanisms available to you to complain about our refusal.
Where your consent has already been provided, you may withdraw consent to our use of your Personal Information at any time by notifying us at [email protected].  We will respond to your request within a reasonable period of time.
We will take all reasonable steps to ensure that your Personal Information that is in our possession is accurate, up-to-date and complete.  If you are aware that any of your Personal Information is inaccurate, incomplete or out of date, please inform us so that we can update our records.
